Is the soldier Innocent of Guilty?

PFC Soldier [using no names for families sake] was fresh out of BCT (basic combat training) and AIT (advanced individual training). He was deployed to the sad pit (Afghanistan) for 18 months, His MOS (military operational specialty) was infantry. While on guard duty PFC Soldier was approached by a muslim woman. He ordered her to halt. These orders were not followed. While awaiting orders from his NCO PFC Soldier repeated the orders in (halt) in Arabic. The ladies approach quickened. once in a 50 meter range with no command yet given the muslim lady began to run towards the privates post. PFC Soldier opened fire killing the woman. It turned out she was unarmed and non hostile. PFC Soldier is now facing murder charges. I am very torn on this. What is your opinion? ~SPC Rowland~
